What is the issue?

The issue was Gopal Ghosh was the owner of R.S. Plot No. 502, R.S. Khatian No. 10, J.L. No. 16 of Mouza Bandra, P.S. Katwa, Dist. Burdwan. The respondents had requisitioned the land for the purpose of implementation of the scheme, ‘Construction of Katwa Protective Embankment along the river bank Ajoy’ in the year 1979 with assurance to make rental payments against the acquisition.

Pursuing relentlessly with the concerned authorities produced no yield, and the respondents failed to pay any rent/interest to the petitioner against the acquired land for the above project. As per West Bengal Land Requisition and Acquisition Act, 1996, the amounts were to be paid to the petitioners within a period of one year which the respondents failed to comply with.

Upon being approached by the petitioners, Advocate Rajesh Kshetry helped them retrieve the long outstanding amount.

This property ran into dispute in 2009. Advocate Rajesh Kshetry’s accurate arguments led the Ld. Judge to pass the order against the respondents thus compelling them to pay the compensation money.
