The Supreme Court has reserved its judgment in the case of Jane Kaushik v. Union of India & Ors., where a transwoman teacher alleged termination from two schools in Gujarat and Uttar Pradesh due to her gender identity.
A bench of Justices JB Pardiwala and R. Mahadevan heard the plea, directing written submissions within two weeks. Notices were issued to the Union, State Governments, and schools to respond to claims of discrimination.
This case invokes the 2014 landmark NALSA v. Union of India judgment, which recognized transgender persons as the third gender, prohibiting discrimination in employment and education. The Court’s decision will further test the enforcement of the Transgender Persons (Protection of Rights) Act, 2019.
