Sexual Assault Case Under The POSCO Act Of 2012

Facts

Mr. X was charged under the Protection Of Children from Sexual Offences (POSCO) Act. 2012, wherein he was accused of having sexually assaulted a minor girl. Mr. X was hiding at the adjustment house where the girl resided. He had committed a penetrative sexual assault upon the minor victim with several parts of his body many times and on many occasions for atleast one year.

When the minor used to protest the said heinous act committed by Mr X, he used to mentally and physically pressurise her. He would remind her that if she protested, then she should have to face dire consequences regarding the same. Hence, Mr. X was punished under sections 376 and 506 of the Indian Penal Code of 1860, along with section 4 of the POSCO Act of 2012.

Solution

Mr. X approached Kshetry and Associates regarding this case in order to defend him. Kshetry and Associates, on behalf of Mr. X, had presented the application for bail at the Court of Law. However, after several tries the bail was rejected by the Hon’ble High Court and also the allegations that were against him were proven to be true in nature.
