Compensation for Occupied Land from the Government – Ms. Gorai’s Case

Client's Problem:

Ms. Gorai’s family-owned land had been acquired years ago by the government under the West Bengal (Land Requisition & Acquisition) Act, 1948. Although the government had taken possession, they never paid her the compensation she was legally entitled to. Despite repeated visits to government offices, she was met with bureaucratic red tape, indifference, and humiliation. Her ancestral property seemed lost forever.

Challenges:

The acquisition had happened decades ago; tracing documents and establishing ownership amidst government apathy was immensely difficult.

How Kshetry And Associates Helped:

Led by Advocate Rajesh Kshetry, the team:

   ●    Filed a writ petition under Article 226 of the Indian Constitution
   ●    Presented evidence that the government failed in its statutory duty to pay
   ●    Argued that such non-payment violated her Fundamental Right to Property
   ●    Highlighted administrative inaction and invoked past court precedents

Result:

The Court ruled in favor of Ms. Gorai and ordered the State to pay her full compensation along with accrued interest.

Client’s Reaction:

Ms. Gorai, an elderly woman, folded her hands in gratitude and said through tears,
“After decades of helplessness, today, justice stood by my side. Thank you, Advocate Kshetry.”
