Brij Ratan Mohta & Ors Vs The State of West Bengal: Dispute Against Kolkata Municipal Corporation

What is the issue?

The issue was Brij Ratan Mohta & Ors., owner of premises No. 173 and 174 Maniktala Main Road, Calcutta comprising of 2 bigha, 9 cottah, 1 chittack 43.sq.ft land, and had applied for Mutation of his property. Accordingly, Dy. Assessor, Kolkata Municipal Corporation inspected the premises but wrongly recorded it as ‘R.T.D.H. Land and Tank’ and hence the mutation certificate was also prepared erroneously.

The petitioners tried all possible means to get the errors corrected in the Mutation Certificate but the bigwigs of Municipal Corporation exhibited their authority and flexed their muscles refusing to comply with the petitioner’s request.

Upon contacting Advocate Rajesh Kshetry as their last resort for relief, he bailed them out with the desired solution of getting the Mutation Certificate corrected.

His appropriate and correct argument as also his ability to nail the respondents compelled the Ld. Judge to pass necessary directives to the Water Body Management Board and Kolkata Municipal Corporation to rectify the wrong doings and correct the Mutation Certificate and ensured that justice is granted to the petitioners.

Advocate Rajesh Kshetry, once again succeeded in providing relief to the harassed petitioners and rectified the wrong mutated copy correctly , thus adding another feather to his cap.
